Listed Chemical Substances

For the normal development of its teaching and research activities, Miguel Hernández University  uses  a number of chemical substances that have been classified as  drug precursors  under  Regulation (EC) No 273/2004 of the European Parliament and of the Council of 11 February 2004 on drug precursors . These substances, diverted from their legal use, can be used to manufacture various types of drugs or narcotics.

The relevant regulations establish the control measures for these substances, as well as the sanctioning procedure, with the  Ministry of the Interior being  the competent authority with regard to the  control and supervision of their trade at the national level.

For this reason, the  Ministry of the Interior  maintains a  General Register of Operators of Listed Chemical Substances , in which individuals and legal entities that carry out operations with listed substances must register.  The UMH, as a user of listed substances, is registered in this register .

Each year, the  Ministry of the Interior  requests information on the purchase, use, and storage of listed substances. To this end, the  UMH  must complete the ” Annual Questionnaire for the Declaration of Operations with Listed Chemical Substances .”

The  SATDI (Technical Support Service for Teaching and Research),  at the request of the Vice-Rectorate for Research and Transfer, is the unit responsible for communication between the  UMH  and the  Ministry of the Interior , receiving the questionnaire and subsequently forwarding it to the various Departments, Research Institutes, Services and Units of the UMH, which are ultimately responsible for the control and use of the listed substances, as well as the declaration made about them in the various questionnaires.

After the questionnaires are sent to SATDI, our service consolidates them into a single questionnaire, which is then submitted to the  Ministry of the Interior  annually within the required timeframe. SATDI will provide the necessary guidance to ensure the correct completion of the questionnaire by the various units and will forward   any questions that may arise regarding the listed substances to the Ministry of the Interior .

To clarify certain technical and legal aspects, we have attached the following information:

  • Listed substance any substance listed in  Annex I to Regulation (EC) No 273/2004 of the European Parliament and of the Council of 11 February 2004 on drug precursors, and which may be used for the illicit manufacture of narcotic drugs or psychotropic substances, including mixtures and natural products containing such substances. Medicinal products as defined in Directive 2001/83/EC of the European Parliament and of the Council of 6 November 2001 on the Community code relating to medicinal products for human use, pharmaceutical preparations, mixtures, natural products and other preparations containing listed substances whose composition is such that they cannot be readily used or extracted by readily applicable or economically viable means.
  • unlisted substance : any substance which, although not listed in  Annex I , has been identified as having been used in the illicit manufacture of narcotic drugs or psychotropic substances
  • user : any natural or legal person who, not being an operator,  possesses a listed substance and is involved in the processing, formulation, consumption, storage, preservation, treatment, packaging, transfer, mixing, transformation or any other use of listed substances
